GENDER GAP IN SOCIAL MEDIA: INTERNET IS NOT A PLACE FOR FEMALE ATHLETES (di Angela Busacca)
Abstract:
Il “gender gap” rappresenta ancora oggi una delle problematiche più attuali nel mondo dello sport: l’evoluzione degli ultimi decenni, che pure ha portato a una nuova visibilità dello sport femminile, ha evidenziato come persistano troppe differenze fra atleti uomini e atlete donne. Tra le questioni più rilevanti si pone quella relativa alla rappresentazione mediatica dello sport femminile e alla percezione da parte del pubblico, soprattutto con riferimento alle comunicazioni attraverso i social media. Una recente analisi (“Social Athletes” realizzata nel 2020 da Blogmeter per DAZN) relativa alle interazioni social del pubblico italiano ha evidenziato alcune situazioni peculiari: le pagine e i siti di informazione sportiva riportano principalmente notizie relative allo sport maschile, mentre lo sport femminile trova maggiore spazio solo nelle pagine o siti dedicati o nelle fan-page tematiche. Con riferimento alle notizie relative alle vittorie sportive di una donna atleta quasi il 25% dei commenti riguarda l’aspetto fisico, mentre in caso di vittoria di atleta uomo, la percentuale scende al 2%; gli atleti uomini ricevono commenti sull’aspetto fisico o sul look quando postano contenuti relativi alla vita quotidiana “fuori dal campo”, mentre per le atlete i commenti sull’aspetto sono una percentuale costante anche nei post a contenuto prettamente sportivo. Tra i commenti e le interazioni social rivolte alle atlete c’è, inoltre, una percentuale di contenuti volgari, molesti ed offesivi: i dati hanno registrato che nel 2020 quasi due commenti ogni dieci appartenevano a tale categoria. Prendendo le mosse dai dati dell’analisi “Social Athletes”, il presente lavoro si focalizza sul gender gap nelle comunicazioni social a contenuto sportivo, analizzando anche il ruolo del linguaggio e le possibili strategie per una corretta social media education nei confronti dello sport femminile.
The gender gap still represents one of the most current problems in the world of sport: despite recent evolution, which has led to a higher visibility of women’s sport, too many differences persist between male and female athletes. One of the most relevant issues related to the media representation of women’s sport and public opinion, regards social media communications A recent analysis carried out in 2021 by Blogmeter for DAZN on social interactions of the Italian public highlighted some peculiar situations: sports information pages and sites mainly report news relating to men’s sport, while women’s sport is found only on dedicated pages, or on thematic fan-pages. 25% of the news relating to sports victories of female athletes regard comments on the physical aspect, while in the case of a male athlete victory, the percentage drops to 2%; male athletes receive comments on their physical appearance when they post content relating to daily life off the pitch, while for women athletes comments on look are a constantly high percentage even in posts with purely sporting content. Starting from the data of the DAZN “Social Athletes” analysis, the paper focuses on the gender gap in sports social communications, also analyzing the role of language and possible strategies for social media education towards women’s sport.

ILLECITO SPORTIVO DEL MINORE E RESPONSABILITÀ DEI GENITORI, DEGLI ISTRUTTORI E DEGLI ALLENATORI EX ART. 2048 C.C. (di Vincenzo Putortì)
Abstract:
Il contributo affronta un tema classico del diritto sportivo: l’illecito sportivo e i profili di responsabilità incombenti sul giovane atleta e sui soggetti preposti all’educazione, all’istruzione, alla vigilanza e al controllo. Considerando il duplice piano della rilevanza dell’illecito del minore sia con riferimento alle regole sportive, sia alle regole comuni di responsabilità civile, viene analizzata l’area di operatività della cd. scriminante sportiva e l’operatività dell’art. 2048 c.c. in ambito sportivo. Da ultimo, viene altresì preso in considerazione il profilo della responsabilità dei genitori con riferimento alla c.d. culpa in educando ma soprattutto all’innegabile apporto dei genitori alla crescita e allo sviluppo della personalità del minore.
The essay focuses on a classic theme of sports law: sports injuries in young athletes and the profiles of responsibility of the young athlete himself and of those in charge of education, instruction, supervision, and control of the athletes. Abstract:
Il lavoro analizza l’evoluzione dell’attività sportiva per soggetti disabili, soffermandosi in particolare sulle problematiche riguardanti lo svolgimento di attività sportive rischiose da parte dei soggetti con disabilità psichica; problematiche, queste, che attengono al rapporto tra la tutela della salute intesa come interesse della collettività e la tutela della salute intesa come diritto alla ricerca della felicità, che coinvolgono peraltro la questione dei limiti agli atti di disposizione del proprio corpo, e che vengono risolte attraverso un continuo dialogo tra ordinamento sportivo e ordinamento statale.
The essay analyses the evolution of sports activity for disabled people, focusing in particular on the problems concerning the performance of risky sports activities by people with mental disabilities. Focusing on those critical point, it is possible to explore also some profiles regarding the relationship between the protection of health understood as the interest of the community and the protection of health understood as the right to the pursuit of happiness, which also involve the question of the limits to disposition of own’s body, and which are resolved through a continuous dialogue between the sporting system and the state system.

DIRITTO PENALE E CORRUZIONE NELL’AMBITO DELLE COMPETIZIONI SPORTIVE: LO STATO DELL’ARTE (di Emanuele La Rosa)
Abstract:
Il contributo analizza i rapporti tra diritto penale e fenomeni corruttivi in ambito sportivo, partendo dall’attenzione riservata al fenomeno dalla “Convenzione del Consiglio d’Europa sulla manipolazione delle competizioni sportive” (2014). Dopo aver analizzato i diversi modelli di intervento penale sperimentati nei diversi ordinamenti europei e in Italia, si perviene alla conclusione dell’opportunità di una criminalizzazione della corruzione sportiva, da realizzare – come previsto dalla l. 13 dicembre 1989, n. 401 – attraverso una norma incriminatrice autonoma e distinta dalla corruzione privata generalmente intesa.
The essay analyzes the relationship between criminal law and corruption in sports, starting from the attention paid to the phenomenon by the “Council of Europe Convention on the manipulation of sports competitions” (2014). After analyzing the different models of criminal intervention experienced in the various European legal systems and in Italy, the conclusion reached is that it is appropriate to criminalize bribery in sports, through an autonomous incriminating law distinct from other forms of private bribery, as provided by law 13 December 1989, n. 401.

L’articolo si propone di analizzare i presupposti giuridici e fattuali del contenzioso che ha coinvolto il tennista Novak Djokovic, cui è stato annullato, dal Ministro dell’Immigrazione, il visto in precedenza ottenuto dal governo australiano in ragione della sua partecipazione agli Australian Open di Melbourne.
The article aims to analyze the legal case which has been involved the tennis player Novak Djokovic, whose visa previously obtained by the Australian government, due to his participation in the Australian Open Tennis Championship in Melbourne, was after cancelled by the Minister of Immigration.

Su cosa di basano i bandi sportivi e il divieto di partecipare alle manifestazioni internazionali a carico di rappresentative, club e atleti russi?

Abstract:
Tra le trasformazioni più rilevanti della popolazione urbana degli ultimi anni, appare significativa la crescita della c.d. popolazione metropolitana sportiva, composta da tutti quegli sportivi che non praticano attività agonistica ma si dedicano assiduamente ad attività sportive per finalità di benessere o ludiche sfruttando gli spazi urbani. Conseguenza di ciò è anche un ripensamento delle modalità di fruizione degli stessi spazi utilizzati per tali attività, che non sono più solo gli impianti sportivi di quartiere ma sono spazi verdi o stradali o di prossimità a fiumi e laghi.
Nel saggio di Lo Verde e Pepe vengono evidenziate proprio le trasformazioni non solo della popolazione cd. “sporty fit” ma altresì delle modalità di vivere e interpretare gli spazi urbani. L’autrice della recensione offre una lettura di queste trasformazioni che reinterpreta la matrice sociologica del saggio per offrirne una lettura in chiave di sociologia giuridica, rivolgendosi alle caratteristiche delle attività svolte ricondotte alla unitaria nozione di sport.
Among the most significant transformations of the urban population in recent years there is the growth of the so-called metropolitan sports population, made up of all those sportsmen who do not practice competitive activities but devote themselves assiduously to sporting activities for wellness or recreational purposes by exploiting urban spaces. A consequence of this is also a rethinking of using the urban spaces, which are no longer just the sports facilities in the neighbourhood but are green or road spaces or near rivers and lakes.
In the essay by Lo Verde and Pepe, reviewed by Santoro, the transformations of the so-called “Sporty fit” population are highlighted but there is also a focus on the ways of living and interpreting urban spaces. The author of the review also offers a reading of these transformations that reinterprets the sociological matrix of the essay to offer a reading in the key to juridical sociology, addressing the characteristics of the activities carried out linked to the unified notion of sport.

EVENTI SPORTIVI E VIOLENZA “SUGLI SPALTI”: PROSPETTIVE DI ANALISI STORICA (Riflessioni sul volume di Fabio Milazzo: “Il tifo violento in Italia. Teppismo calcistico e ordine pubblico negli stadi (1947-2020)” (Franco Angeli 2022) - Antonio Baglio)
Abstract:
La violenza in occasione di manifestazioni sportive rappresenta una problematica molto attuale, che ha determinato diversi interventi del legislatore, sia di quello statale che di quello sportivo, e richiede una costante attenzione da parte di tutti gli operatori del settore sportivo. L’analisi proposta assume un diverso punto di vista e indaga sia le ragioni storiche che l’evoluzione della violenza in occasione di manifestazioni calcistiche lungo tutta la seconda metà del secolo scorso e i primi decenni di quello attuale. Il volume qui recensito arricchisce di un importante tassello non solo la ricerca storica, ma altresì offre ai giuristi e a quanti si occupano di diritto sportivo un punto di vista complementare per comprendere ragioni e articolazioni – ricostruendone con accuratezza il contesto in cui è maturata – dell’attuale normativa di contrasto alla violenza negli stadi.
Violence at sporting events represents a very topical problem, which has led to various interventions by legislators, both state and sporting, and requires constant attention from all operators in the sporting system. The proposed analysis takes a different point of view and investigates the historical reasons and the evolution of violence during sporting events throughout the second half of the last century and the first decades of the current one. Fabio Milazzo’s book, which is object of the review, appears as an enriching element not only for historical research, but also as it offers jurists and all those involved in sports law a complementary point of view to understand the reasons and articulations of the current legislation to combat violence related to sporting events.
