Abstract: Le Olimpiadi rappresentano la più importante e imponente delle manifestazioni sportive a livello planetario, capaci di incidere nella storia contemporanea non solo per la valenza agonistica, ma in relazione ai molteplici risvolti di natura economica e politica connessi alla loro realizzazione. Il saggio ripercorre a grandi linee la vicenda più che centenaria dei Giochi olimpici moderni, a partire dall’idea decoubertiana di riportarli alla luce alla fine dell’Ottocento, in collegamento ideale con quelli dell’antica Grecia, per analizzarne le diverse fasi che ne hanno scandito la crescita e l’affermazione come evento sportivo mondiale, la cui storia si è strettamente intrecciata con la diplomazia internazionale, la propaganda politica, i boicottaggi, il terrorismo, le rivendicazioni nazionali, le lotte per i diritti civili.

Olympics Games represent the most important and impressive of sporting events on a planetary level, capable of impacting contemporary history not only for the competitive value, but also in relation to the multiple economic and political implications. The essay broadly traces the more than centennial story of the modern Olympic Games, starting from the idea of Pierre de Coubertin aimed to bring them back to light at the end of the nineteenth century, in ideal connection with those of ancient Greece. The essay also analyzes the different phases that have marked Olympic Games growth and affirmation as a world sporting event, whose history is closely intertwined with international diplomacy, political propaganda, boycotts, terrorism, national claims, struggles for civil rights.

Abstract: Per la prima volta nella storia delle Olimpiadi assisteremo a una edizione dei Giochi estivi celebrata in assenza di pubblico e con una eccezionale copertura mediatica: le misure determinate dall’emergenza sanitaria hanno reso necessario, infatti, escludere il pubblico e permettere solo una visione in streaming. Questo dato ha reso ancor più necessaria la predisposizione di regole di comportamento per gli atleti nell’utilizzo dei social e dei digital media che, nel corso degli ultimi anni, hanno evidenziato tutto il proprio potenziale comunicativo e promozionale: sono sempre di più gli atleti, le società e in generale i protagonisti del sistema sportivo che sono presenti sui diversi social ed interagiscono con i propri supporter creando nuove modalità di comunicazione e di fan engagement. Il presente lavoro, muovendo dalla considerazione della rilevanza, comunicativa e commerciale, della presenza social degli atleti, analizza le disposizioni del documento predisposto dal CIO per l’utilizzo dei profili personali social degli atleti e dei soggetti accreditati, al fine di incoraggiare la condivisione delle esperienze olimpiche ma al contempo di tutelare diritti e situazioni di esclusiva sulle gare e sulle cd. olympic properties, che sono di pertinenza esclusiva del CIO e costituiscono una delle principali fonti di introiti.

For the first time in the history of the Olympic Games we will see an edition of the Summer Games celebrated in absence of the public and with a reinforced media coverage. The exceptional measures triggered by the health emergency entailed the need to exclude the public and thus allow exclusively the broadcasting thereof. This situation has made it even more necessary to enact rules of conduct applicable to the athletes in connection with the use of social and digital media which, over the last few years, have shown all their communicative and promotional potential. More and more athletes, clubs and in general all protagonists of the sports system currently hold personal social media accounts and manage them through various social networks; through their account, athletes can interact with their supporters, create new methods of communication and fan engagement. The essay starts from the analysis of the communicative and commercial relevance of the social accounts of athletes, then focuses on the provisions of the IOC Guidelines for the use of the social and digital media, particularly on the management of personal social profiles of Olympic athletes and participants. The IOC, clearly, wants to encourage the sharing of Olympic experiences and, at the same time, protect the broadcasting and media rights on the Olympic Games and the so called “Olympic Properties“, which are the exclusive property of the IOC and constitute a major source of revenues.

Abstract: La Carta olimpica da quasi 50 anni preclude la manifestazione di opinioni politiche e la propaganda durante i Giochi olimpici; anche prima della espressa introduzione di una regola in tal senso, gesti politici ormai leggendari furono di fatto sanzionati. Il CIO ha confermato la validità della Rule 50.2 anche per le Olimpiadi di Tokyo, seppure definendo linee guida meno restrittive. Ragioni, criticità, dettagli e considerazioni personali su una regola in continua evoluzione.

The Olympic Charter has been banning for almost 50 years any political opinions and propaganda during the Olympic Games; even before an express rule had been issued therein, (now legendary) political actions have been effectively sanctioned. The IOC confirmed the validity of Rule 50.2 ahead of the Tokyo Olympics but it issued less restrictive guidelines. Reasons, problems, details and comments on such constantly evolving rule.

Abstract: L’articolo propone una descrizione del funzionamento della Camera Ad Hoc del Tribunale Arbitrale dello Sport di Losanna (“TAS”) per i Giochi Olimpici. Premessi cenni storici circa la nascita della Camera Ad Hoc, l’articolo analizza le previsioni applicabili alla procedura arbitrale ai sensi del “Regolamento arbitrale olimpico”, con enfasi sulla necessaria celerità che caratterizza il procedimento, per poi soffermarsi sul diritto applicabile al merito della controversia. Il contributo prosegue poi con una breve rassegna dei casi più interessanti che hanno caratterizzato la Camera Ad Hoc con riferimento, in particolare, all’impugnabilità delle decisioni rese “sul campo”.

The article provides an analysis of the Ad Hoc Division of the Court of Arbitration for Sport in Lausanne (“CAS”). After an introduction concerning the creation of the Ad Hoc Division, the article analyses the provisions applicable to the arbitral procedure pursuant to the “Arbitration Rules for the Olympic Games”, with an emphasis on the necessary expedition, which is a core feature of these proceedings, the essay focuses on the law applicable to the merits of the dispute. The article further offers a brief review of the most interesting cases that the CAS Ad Hoc Division has dealt with, particularly with respect to the appealability of “field of play” decisions.

Abstract: L’organizzazione dei Giochi Olimpici costituisce, sin dalla loro primigenia apparizione, un momento di raccordo tra molteplici voci e interessi, che non sempre nella storia hanno trovato concordanza. Le esperienze olimpiche moderne, infatti, hanno mostrato un trend di preoccupante insostenibilità, non solo dal punto di vista economico-finanziario. Trend che, grazie alle recenti riforme del Comitato Internazionale Olimpico, cerca soluzione di continuità nell’edizione di Tokyo 2020, nella quale le New Norm olimpiche troveranno una prima attuazione, mostrando l’effettiva tenuta dell’attuale sistema e rischiando di sollecitare un nuovo momento di riflessione della governance olimpica.

The organization of the Olympic Games has been, since their first edition, represents a tense moment given various, and sometimes diverging, needs and interests. The latest Games have in fact shown a worring financial and economic unsustainability trend. The International Olympic Committee has issued significant reforms to change such trend including ahead of the Tokyo 2020 edition and the New Rules will apply for the first time, hopefully proving the effective sustainability of the current system and thus probably resulting in further Olympic governance potential improvements.

Abstract: Il contributo esamina le vicende cha hanno portato all’emanazione del d.l. 5/2021, di riordino dei rapporti tra il CONI e la società “Sport e Salute”, con il subentro del primo in molte delle competenze che, a partire dal 2018, erano state affidate alla seconda. E come il Decreto tenda a restituire al Comitato Olimpico Nazionale Italiano la necessaria autonomia e centralità e sgomberare il campo dai dubbi in ordine alla autonomia dello sport rispetto alla politica sollevati dal Comitato Olimpico Internazionale (CIO), che avevano indotto il CIO a mettere in discussione la partecipazione degli atleti in rappresentanza dell’Italia alle Olimpiadi di Tokyo 2020.

The essay analyzes the factual background that resulted in the enactment of the Legislative Decree 5/2021 on the reform of the relationship between the Italian Olympic Commitee (CONI) and the company “Sport and Health”, whereby CONI substituted the latter in a number of tasks that were originally under the aegis of said company. The essay further focuses on how the above mentioned Decree aims at ascribing to CONI the (necessary) autonomy and central role as well as ensuring the sports’ separation from the political influences, which the International Olympic Committee (CIO) had criticised, to the point that the latter had questioned the Italian athletes’ participation in the Tokyo 2020 Olympics.
